Faulty card & returns question

I had a 7950 that refused to work with SWTOR. I tried all sorts with it, starting with changing the drivers to rebuilding the OS. I used 12.2, 12.3, 12.4, 12.6 beta, 12.7 beta and I think 12.6 release just before I sent it back. No matter what I tried, I'd get glitches in SWTOR and lines going over the screen. The only way to solve this was to alt-tab to desktop and load the game again. I saw artefacts in BF3 once, but didn't play it much.

Temps are fine, rest of the system is fine.

In the end I sent it back to the person I bought it from. I bought a GTX 670 to replace it and have had happy gaming with zero issues since.

The guy I sent it back to has tested the 7950 with 3 systems and says it's not faulty, and won't give me a refund.

My system worked with single and dual 5850's before I bought the 7950 when the problems started.

Where would you say I stand with this? Would you want a refund still?

Difficult one if it was fine in all other games. Did he test it in SWTOR? It sounds like to me the issue is either localised to that game or that game exhibits the fault with the card. Or even a driver issue.

Really difficult to tell which way without extensive testing. The problem is, without proof the seller will say (rightfully I guess) that the problem is with the game rather than the card.

I'm not an expert on rights but unless you can prove it I don't think you are on firm ground.
 
I would guess its more of a problem with your system if it only happened in one game, perhaps a conflict in the cfg files or something. I think you might just have to take the card back and sell it on, but obviously I wish you luck in getting a full refund :)
 
That's what I would think as well, but I did a complete rebuild, and, as I said, it worked fine on a single 5850, dual 5850's and now the 670.
 
probably some weired compatibility issue (expecially if you can get round it with some alt tabery...

if you brought it second had its your problem... (i assume its second had since you say "guy rather than shop)
 
The hard part is proving it is faulty and by the sounds of it, you can't. I would get the card back and sell it on. It doesn't sound right though, as you could alt + tab and restart and all was good.

Maybe you can put the card back in your comp and video it having the issues and then send it to the seller? This at least proves it is faulty in your system. Also send him a video of the 670 performing correctly.
 
I'd rather avoid sending the card backwards and forwards, it's just under £10 special delivery each way. I've sent enough proof that it doesn't work in my machine.

that they seem to have deliberately delayed you sending back the card indicates that they may be being somewhat less than honest with their side of things

how did you pay for it? if paypal then I would raise a claim - in nearly all instances the "easiest" out for paypal is to tell you to send back the item and they will issue a refund, as you've already returned the item you should get your money back (assuming you have the tracking details)
 
Yes what Gregster says is your best bet. How much of a loss would you make if you got the card back and sold it on?

No idea what a second hand Sapphire 7950 OC goes for, but I don't think that much at all.

It just fustrates me as I'm no idiot and I tried everything with that card, lo and behold as soon as I drop another card in my rig it all works perfectly again.

Honestly, it's been going on for so long that I don't remember. I'd have to check my screenshots on my PC to be sure.

I paid via Paypal, and I should have the postage receipt and tracking number right here. I don't want it to go to that though.
 
I think as the guy has already said that he won't give you a refund that that is going to be your only option

it depends how sure you are that the card was faulty - if you are sure then why should you be out of pocket for a faulty card? if on the other hand you think that he's right and that there was another issue your end and that you deserve to be out of pocket for a non-faulty card then agree to take it back and resell it yourself

bear in mind that if the card IS faulty and you agree to take it back and sell it yourself - if someone else has the same problem and demands a refund from you, you are then sat with a very very expensive red paper weight
 
It's someone that runs a review site, who reviews cards and then at times sells them on. It doesn't take a genius to look through my recent posts to figure out who it is.
 
why haven't you raised a paypal claim yet?
but also, name and shame to prevent other people getting ripped off in the future

if he's so certain it's not faulty then he should have no problem reselling it himself
