Faulty Graphics card?

I got an Inno3d GTX 470 graphics card as an xmas present, but I'm having a bit of bother with it.

The main issue is this:

Approx 1 in 10 times of starting up the PC, the graphics card fan doesn't start. If you just leave it, the graphics card overheats and eventually you lose video, a short while after this my PC reboots.

I've found that during this point if i "kick start" the fan with my finger, everything works fine.

There is nothing obstructing the fan as far as I can tell and the fan turns freely when I move it around with my finger.

I have noticed that the fan does seem to be exceptionally noisy, louder than my whole PC. it doesn't seem to be a mechanical/grinding noise, but noise like it seems to be working overtime for no reason. In comparison to my old GTX 260 I would have to turn the fan up to around 70% in MSI afterburner to get to the same level of noise I get from this card at stock, running nothing but windows desktop.

It doesn't seem to be running hot at all, sitting at 41c so I can't understand the need for it to be spinning so fast.

Apart from that, performance seems fine on the card, but I think I may just have faulty card, perhaps a faulty fan controller on it?
