Faulty VTX6870 - fan blade missing

When first opened, the pack with the GPU looked fine, when the GPU was plugged in it and powered up, it started to rattle and it almost took the card off it's slot on the MOBO. It appears that a fan blade is missing....like so...

There was no fan blade lying on the ground, in the PC nor even in the packaging that it came in.

OCUK have said because I hadn't opened the package within a certain time that they would not be responsible for the faulty GPU. Anyone got any ideas how I can get this resolved? I've tried to reason with them saying that it must have been before I got it but as I left the package unopened (I bought 2 of the cards but decided to get a single 570 instead) for a few weeks I've no come back. Surely I have got some option to get a replacement or to get a refund? Help I'm out of pocket a whack of money and I just want to get this sorted. Pretty annoyed at OCUK tbh, after the money I've spent on here they are welching out on taking responsibility as a distributor! :mad:

They won't accept it back as RMA. Are they allowed NOT to? I am not an amateur when it comes to PC's and I know that this was missing before I got it. I got it straight from the bag it came in, into the pc without even looking at it properly as I had 2 of the cards and the other one was looked at and crowed over so didn't need to inspect the 2nd one...just whack it in there and get going...
 
You don't have to RMA ot manufacturer. And the manu doesn't have to accept an RMA wih you. OcUK, by law, MUST accept your RMA
 
VTX is powercolor I think, and you will have to return it through your distributor, that being OCUK as I tried to find a place to return my Powercolor card a while back and it was next to impossible.

Many manufacturers tell you to return it to your distributor for warrenty, and distributors try and push you on to the manufacturers, so as long as you have the receipt you can return it to OCUK, especially if within 6 months of purchase.

If you have faulty goods, take them back within six months and the onus is on the shop to prove they WERE NOT faulty when you bought them - only after that must you prove they were. Yet all goods must also last a 'reasonable time', this can a long time for some expensive ones. Full info below on consumer rights.

Try the customer service forum if you got nowhere on the phone, be nice but firm. They are just trying to limit their returns as it loses them money and many people take the hit and miss causing the rest of us to suffer when applying for genuine returns, but I agree if you're a good customer it's kind of like biting the hand that feeds.

James from their CS department says that it's the manufacturers issue and I have to go to them to get a claim number before OCUK will take the card back. Surely this isn't right?
