Fence height query

Seems a bit odd that they'd be asking you take it down, is part of it facing a road, are you living in a conservation area, a listed building or anything out of the ordinary?

Either way it would probably be best to query why you're being told/asked to take it down before challenging the decision, maybe let them know you're considering challenging it so it would be helpful to know so as not to waste everyone's time/create extra work for them.

The regulation states 2m high. Mine is 1.8m fence on top of a 0.4m retaining wall, totalling 2.2m (my side). I have agreed to reduce the height to 2m, but the council is insisting that it comes down. It is an expensive, composite, secure fence, supplied by ‘Charles & Ivy. If I remove the fence it also infringes my privacy.
Then leave it up……if they havent given you a good reason to remove it.

Get council to send someone to inspect it and then get them to give to you in writing the reason for removing it.
 
He has according to the data he has available through the council website and based on other peoples fences. But they are still asking him to remove it without giving a reason….
i'm sure he's stated the fence is 2.2m in height (on the neighbours side) - that's above the permissible level of 2m for boundary fences afaik?
 
But 2mtrs his side…..its not his fault the neighbours property is lower than his.
It’s not but as I posted earlier, the 2m max height is taken from the lowest level adjacent to the fence. The lowest level adjacent to ops fence will be the neighbours garden, so needs to be reduced in height accordingly. It’s crappy for the op but it’s the rules, at least as I understand them.
 
Ignore them until they have a court order for you to remove it. Then if they get that take it down and rebuild it a metre into your land.
Nothing they can do about that.
Imagine being such a petty gimp that you'd give up a meter of your land to have a 20cm higher than allowed fence.

Believe it or not, in essence that’s what the neighbours on one side of us did - though with trees. done previous to us buying - I know them and when we moved in it was the first thing the husband explained to me - they wanted a fence, but are on higher ground, council and previous owners were arsey about the height it could be so he planted conifers a metre back from the boundary and they’re well in excess of 2m above our garden. It’s not an issue for us, nor would the fence height have been either as it’s a side garden and as it runs NW it doesn’t hinder sunlight.

Exactly my point. It’s not on a road - it’s the side of the house, between 2 houses. Not a conservation area. Not a listed building. I have told them I am going to be challenging it. I’m going to speak to an architect to seek advice on an appeal. This will cost but I need help. It’s making us want to move house. I only slept for one hour last night with the stress. But why should we be driven out of our home? I’ve put a lot of sweat, blood , cash and damn hard work into this house.
The neighbour has a ground floor lounge window and a 1st floor bedroom window overlooking us, it is very intrusive and stressful. They are nosy B’s, they have also taken liberties of my ‘reasonable’ neighbourly attitude and we now despise them. The windows are not obscured and they can and do look straight into our house.

I fear you are going to out the architects fees just to be told it needs to be max 2m high measured from the neighbours side. From what you’ve posted there aren't really any grounds to appeal or challenge it that are going to be successful. Settle for the max permissible height or plant trees/bushes.
 
Bit of a rogue suggestion but could you not try and have a word with them and come to an agreement on height between you both?

I'm sure they don't want to be able to see directly into your house as much as you.
