He was there first they chose to move in their problem not his.
Smoking inside with other people who don't smoke is a big no-no
If it's advertised as non-smoking then it's non-smoking regardless of who was there first or how long he's been getting away with it.

I still fail to see why he has any right to smoke inside when:
1. It's been advertised as a non-smoking abode.
2. His past housemates have protested against it.
3. His two current housemates don't want him doing it.
Who's clearly the asshat here?
Just because the LL doesn't want confrontation doesn't mean the OP can do what he wants.

Was it when he signed the contract? which is the only point in time that it counts
2. His past housemates have protested against it.
No longer matters as they're not there
3. His two current housemates don't want him doing it.
Again it's blatantly obvious as soon as you walk into a smokers house that someone smokes inside yet they still decided to move in, that's their problem not his

Bottom line is, OP is being an inconsiderate ass about it.
The other two housemates are entitled to live in a smoke-free environment if that's what they've signed to.
2v1, I wonder where the least hassle for the LL will be?

Stop smoking, you're stinking the place out and making her and her clothes smell.
Can't you smoke outside?
