I had an incident last year involving me getting scammed by a buyer wanting a refund after one month and sending me back a damaged sound card with half of it missing. http://forums.overclockers.co.uk/showthread.php?t=18157337

I refused to pay the letters but they have come back with.

RE: EBAY BUYER PROTECTION

We have been contacted by iQor Recovery Services Ltd in relation to monies owned to EBAY BUYER PROTECTION for the sum of £152.99.

If full payment, or your proposals for payment, are not received by iQor Recovery Services Ltd within 10 days from the date of this letter, it is likely that we will be instructed to commence legal proceedings against you. Any legal action will include a claim for additional legal costs and interests that may accrue.

Please note we are instructed NOT to enter into correspondence with you at this stage but to refer the matter to our client iQor Recovery Services Ltd. Please contact them directly to avoid the necessity of such action.

Any lawyers on OCUK? Do I stand a chance in court on my own?
 
LMAO no not on a soundcard.

Basically I got £150 for free.

1. I sold soundcard for £150.
2. Guy returns it (albeit missing part)
3. I complain to Paypal and they took off the -£150 in my Paypal account from the buyers refund.

So Paypal lost out and now I have at least a working soundcard which I can SPDIF out to my Dac. So don't wanna push my luck taking it any further.


wait, according to the last thread, your words: "you got £150 for free" - so shouldn't you just pay up?
 
OP - contact them in writing/email with original pictures of the product and then the damaged product with missing parts and say no chance, product was sent back damaged and not working. End of...
 
Your a long way from going to court with a letter like that. Just standard debt collecting stuff.

I was on your side, right up until you were unscrupulous in the first instance. Despite being done over your attitude seemed pretty bad towards the whole thing to be fair. That is, considering you got refunded?
 
They aren't suing you, they've got a money from the "collection agency" in the office downstairs in the hope that you'll give them the money.

Chances of court are slim as they don't like their "protection" schemes being dealt with by people with real legal knowledge.
 
True but in fact I didn't because the guy only sent back half the sound card. It costs £150 but without the front external it's only like £40 worth. Plus it was after a month he bought it and he sent it back bent in half.

My attitude was more of a peed off at eBay. They refunded him before I even got the card, he could have just sent a brick. If he had sent the card properly instead of screwing me over.. I noticed now paypals policy on that has changed since...

Doesn't sound like it is going to go to court anytime soon.
