Front seat release...MOT failure?

Hi all. My missus has a three door Astra and the seat release on the driver's side, that lets the seat come forward to access the back, doesn't work . I presume this is a broken cable. Does anybody know if this is an MOT failure?
 
If it isn’t 'secure' it's a fail. Mine is secure unless you move it, then it can only be secure in one place because it can't move the holder so slides all over. So I held it in place with a screw, so you can't move it and then chuckle at a 6'5 man of fat squeeze in.

:) It is secure, it just wont operate and tilt the seat forward.

no MOT fail for that but I'd get it fixed if you ever have rear seat passengers it's highly unlikely but would you want to be responsible for a rear seat passenger getting stuck to long and burnt alive?
