I received the phone today. It is not brand new as described (probably refurbished at best). It is also locked to Vodafone, which is totally useless to me, because I want to use it on Virgin (AFAIK this mobile can only be unlocked by some guru-type in a cave somewhere overseas for about £50, and by 3 at the end of the initial contract period) :p

I've asked the seller for a refund plain and simple saying item is not as described and useless to me etc, so I await his reply. I didn't contact him through eBay, as that would've been stupid (they would then know I received the phone).

I asked the phone to be sent insured delivery, and it wasn't. I have the phone, and he has no proof of postage. If he doesn't do as I wish, I guess I can do a Paypal chargeback, saying I didn't receive the mobile later on, then perhaps sell it on to make up the discrepancy from the chargeback fees. The ball is in my court as far as I can see.

Does it still stand that the 6680 is not unlockable?

Any info would be gratefully received :( :confused:

Sorry to hear about what happend, a chap at work has a nokia 6630 and wanted that unlocked (locked to T-mobile) only way was to contact T-mobile and ask them for the code.

He tried unlocking calculators and local markets without any joy.
Best bet is to call Vodafone and see what they say.

Yeah, I'll contact Vodafone. Never know, they might help me out. :)

I found on a forum that all BB5 phones can now be unlocked. The only problem is you have to be on a Tunisian network :p . This was announced today. It costs about the equivalent to £45 though!

This is exactly why a lot of people won't buy/sell on ebay now. We have the seller who doesn't describe the item properly and forgets his marbles when he gets to the post office. Then we have you, who is just going to rip the other guy off, instead of going the right way about it all. Oh and you think they don't know you contacted him? He has emails doesn't he -thats all he needs really.

Doen't stop me from making a claim though does it? At the end of the day, I have been ripped off. He hasn't contacted me yet, and I'm quite sure he won't. Not unless threatened one way or another.

I've been looking on the almighty Paypal dispute center, and it seems that I can make a claim if necessary (i.e there is no resolve between me and him). The only problem is that there is a £15 surcharge on claims, so he could have his phone back, but only if he made up the discrepancy of £15. I shouldn't be the one losing out here.

Here's the email I sent:

Hi XXXXXXX.

I received the 6680 today. I am unfortunately unhappy with it. It seems like it was not 'unopened' and brand new. There are wear marks on the battery contacts, and scratches where the rear camera cover slides open and closed. At best this phone was refurbished. The box was not sealed either.

The second problem I have is that it is NOT unlocked. It is therefore totally useless to me, as I have no desire to use it on the Vodafone network, which it appears to be locked to (I use Virgin Mobile).

This would be less of a problem if I was able to wander into town to a local mobile phone store, give over £10 and have an unlocked phone. This is not the case. The 6680, N70, and various other similar Nokia mobiles are not unlockable whatsoever (with the exception on the 3 network, who when you finish your contract with, may give you the unlock code if you ask nicely enough). There is one other place that will unlock it, but it costs upwards of £40 and is located overseas.

I can only come to the conclusion that a full refund is in order, including p&p, as the item clearly was not as described.

The guy has only ever bought stuff before, and has a rating of 100% +ve. The auction I won was his first ever sale. The last couple of days he's sold a PSP and a Gameboy Advance SP, so we'll see what his buyers say about them...

I would love to keep the phone, but seeing as it's on Vodafone, which is just about the worst network for PAYG for myself, there's no point. If it was on Orange, I'd probably consider keeping it.

The guy left me +ve feedback before sending the phone, which is fair enough!

My feedback is at 102 and is 100% +ve. I've never been ripped off before, and certainly never ripped anybody off.

Did you not properly read my second post?

I'll be happy if I get every penny of my money back. If that happens, then he can have his phone back. If he doesn't want to play ball, well then that's his problem.
 
That has crossed my mind, but I still could lose 20 quid if I'm unlucky. I might end up doing that though.

gee man thats bad...Thats just lying and fraud I would have thought, as eventually if you did that you would get your money back off of paypal and also have the phone to do as you please.

Mind you, you never know, he could well be a member of these hear forums.

I think I was being a bit rash at first TBH, I've calmed down a lot about it since yesterday (fighting all afternoon with some MFI furniture, and my inlaws dog urinating all over my house helped put things in perspective).

If I file a dispute, I'll say item not as described blah blah blah. I think I can still perform a chargeback anyway, if there's no resolve. I don't really want to do the guy out of anything, he's just wasted my time, and sold me something useless. Like I say, I would really like all my money back.

You don't buy, say, a camera from a shop, take it home to find it's been used/something's missing and then not do anything about it. You go to the store and demand a full refund. I can't see why I should be short changed because someone wants to shift something on, and lie about it's description to help make it more appealing.

The listing title, listing header itself, and description all state that the phone is brand new, unopened, and unlocked (which it obviously is not).

If I chargeback, I'll lose £15. That's the fee Paypal charge :mad: . If the seller was to foot that bill, then fine, he can have his phone back! Otherwise I'd be sorely tempted to put it on eBay at a buy it now of £15, then send him the completed auction link! Perhaps that's a bit keyboard warrior-ish, but I need the money to buy a different phone. I can't afford one otherwise!

The other thing is I still don't know for sure that the phone isn't barred completely. I've tried it with a couple of different Virgin and O2 sim cards, both of which give the message 'Sim card not valid'. I need to find a Vodafone one (my boss has one, but he never brings his mobile to work, I'll ask him to if I remember). If it's not barred, then obviously it's got some resale value. I'd get between £40-£70 for it, weather pemitting.

The above post I think is far more acceptable. Fair enough, send him a message saying you aren't happy and if you don't receive a reply within x days you will be doing a charge back.

I was looking at them as an alternative, and very nearly bought a C500/550.
