Garage chasing me for service history.

Hi all,

I have recently part ex'd my 04 Corsa for my new motor.

Now the garage that took the Corsa didn't check anything, didn't have a look at the documents, take it for a spin, ask about tax on it.... nothing. Just gave me a price I was happy with and off I went with my new car.

Now a month later they are chasing me for the service history. I knew full well it didn't have any when I bought it as me being an idiot, didn't check. They are also claiming that the price they had given for my car was inclusive of tax but at the time it wasn't mentioned. It did have a good 7 months left on it but since it wasn't mentioned, I thought I'd get a tax refund.

After I first bought the Corsa and then realised it didn't have FSH I called the garage I bought it from and chased. They said they don't have it but the previous owner does and they would call them. The previous owner has apparently just moved house but will look for it. Chased it again shortly after but not heard anything since.

Where do the garage and myself stand in this situation? The chap who owns the garage I bought the new car from (I found this out afterwards) is a bit of a dodgey dealer so I am only going to assume he ain't best pleased with it lol.

I've no idea on the legal standpoint but I'd say that the garage that bought your car bought it "as seen", i.e.:

- the tax was on the car at the time, and therefore was expected to be included

- they didn't see the service history, therefore they shouldnt have expected it to be included unless you told them it was
 
simple, if you know where it was serviced, you should be able to get a duplicate SH from them, it'll be held on the computer etc,

failing that, tell the place you p/x'd it into that it wasn't stated, so if they want SH then it's their responsibility to chase it up with the previous owner (as found on the V5 that you would have given him...)

Well the tax disk was present at the time of viewing, I just removed it afterwards but the SH was never mentioned, nor checked. I only mentioned MOT.

I only got £50 back on the tax anyway.
 
Look at the contract you signed. Or on the receipt. Mo contract or any documentation stating fsh/tax, tell them to take a hike.
 
Tax is an iffy one. On the one hand it was in the car when it was valued so should be included. However you traded in a car not a car and a tax disk.

SH? Just tell them it hasn't got any. You've never claimed its had SH, so they've no real comeback surely?
 
Have you checked the docs you signed the car over with? Does it specify in these documents that Tax and Service history were to be included? If not, tell them where to go :)
 
If the paperwork doesn't specifically say the car was to be included with Tax and Service History, theres little they can do apart from learn from their mistake, even if it was in the paperwork, they should have checked everything was with the vehicle when they collected it/you dropped it off.
 
One thing to bare in mind though is, if you've had a car off them you want to be able to go back to them if you have a problem, I'd probably give them the value of the tax back, but obviously just tell them there's no SH, because there isnt anyway! Keep them sweet.

I've part ex'd for an older car anyways so there is no come back if anything goes wrong and I've since found out it is a dodgey garage anyway, well not the garage necessarily but the bloke that owns it. Well known around this way for being dodgey anyways.

Yup.

Well just spoke with the garage. Explained I don't have it and the previous garage said everything that came with it was in the glove box. He said thanks and sent me on my way (hung up). Seemed ok about it.

End of the day I never said it had FSH or any SH and the guy that sold it never checked (not the dodgey dude). It's his own sales guys fault.
