Probably because it was a dumb move by a developer who's reputation among gamers has sunk drastically since the Aliens fiasco. They had other options besides outright ****canning the game, its no secret that at some point they're making their own Duke game, I don't see how a remake of the original could hurt that. Wouldn't have been hard to make a deal with the modders but nope it got squashed.
Read up the page, they could have made this a retail game instead of squashing a few years of work, looked a lot better than anything that gearbox has put out in a long time.

No it doesn't, it poses a very small message to the incredibly small part of the modding community who do complete overhauls, even then it doesn't even apply to most of them. To be frank, this was not a mod, it is a complete recreation on par with Black Mesa.
All it says is that "there is a line", beyond which a company have every right to say no. Bethesda said no to Morrowblivion (its still out there but not officially supported, not hosted by Nexus etc), Valve said no to the Black Mesa team using the Source title, I highly doubt any company would ever let one of these recreations get out without at least looking at them and adding caveats. I would imagine the reason that Gearbox said no to this is directly linked to the fact they are still planning on using the Duke IP to release their own game created from the gr5ound up, unlike Forever where they picked up the pieces, glued them together and gave the fans "something" for all the time they had been waiting.
I have to say all this hate towards gearbox strikes me as rather juvenile, if you want to dislike them do it for Colonial Marines, that at least was entirely their fault.
