Getting bioshock to work in direct x 10?

Hi I just installed bioshock on my pc but i noticed that the option for dirext x 10 is greyed out so i think its running in dx9.

i have a radeon 4850 and installed the recent driver update.

how do i get it to work in dx10?

You need Vista as your OS it works fine for me under Vista on a 4850 and looks incredible plus the FPS is much better something like 20-25% faster than an 8800GTX so very smooth gamplay.

DX10 Bioshock has better looking water everything else looks similar to DX9 mode.
 
I just checked dxdiag it says direct x version: 9.0c

So that means you cant get dx10 for xp?

the particle effects, such as the fog are much better too.. you don't get any texture clipping as they're softened :)
