GIGABYTE GA-MA790FX-DS5 Dual BIOS Problem

I just purchased this board and a Phenom 9850 BE.
The BIOS that was installed on the board was the F2 version.
Before I installed the board I went to Gigabytes website and downloaded the latest BIOS (F5) and put it onto my bootable USB Drive.
So I built the system and when I turned on the power I was getting nothing, just a black screen.
So I tried my old AM2 4800x2 in the board and it went to POST straight away.
I installed Windows without a hitch and installed all the drivers.
So I then used my bootable USB Drive and updated to ther latest F5 BIOS.
I swapped over the Processors and the system went to POST and Booted up no problem with the 9850 BE.
I ran it through multiple benchmarks and the system seemed to be running fine.
I then went into BIOS to start testing the system for Overclocking, I wanted to isolate the Motherboard to see what Reference I could reach stably so I reduced the CPU multi to x5, reduced the HT to 1600Mhz and set the RAM to DDR2400 and loosened the timings.
Hit f10 to save and exit and at POST I get
"Warning, Main BIOS Checksum Error, reseting BIOS........."
This automatically resets the BIOS back to the F2 BIOS which in turn means I get a blank screen and the board doesn't get to POST with the Phenom in place.
I have tested every component separately and the board runs fine with the F2 BIOS and my old 4800+, overclocking to 3.2GHz on air with stock voltage.
I have tested the RAM on Memtest and have ran the system through Prime95 for 24 hours overclocked and get 0 errors or warnings.
So basically this Main BIOS Checksum error is causing me to pull my hair out, has anyone else had this problem with Gigabyte boards? What solutions if any have people found for this problem? Should I just be sending the board back?
I have a 600w OCZ stealthstream PSU, do you think this may be the problem when the Phenom is in place ie underpowered?
Some feedback or thoughts from members would be greatly appreciated.
