Gigabyte X58A UD3R o/b Network issue

I'm having a few issues with the onboard network card on my X58A UD3R.

Occasionally when I reboot or powercycle my system, I will have no network access. On my 10/100 Linksys switch it shows no connectivity from the NIC, and windows network loops between no network and obtaining address every couple of seconds. When this happens the green LED blinks once and the orange LED blinks a couple of times. This repeats over and over. If I go into the bios and run Smart Lan in Intergrated Peripherals, it reports that there is a 10Mbit link.

Rebooting isn't enough to fix the issue. If I switch the PSU off for a few seconds and boot into Windows, network now works fine, and Smart Lan detects the link as being 100Mbit as it should.

I have not been able to pinpoint why this happens, but it'll just happen upon rebooting, and require loss of power to restore normal function.

Board is running the latest bios, F5. I dual boot both Win 7 and Linux, this issue is apparent in both operating systems.

Is the network card naffed? RMA time? :(

Hate RMA'ing motherboards, nothing more inconvenient!
