Girlfriend almost hit a cyclist

Hi all,

I was a passenger in the girlfriends car today when a cyclist has accused my girlfriend of hitting them.

She was driving along with a zebra crossing up ahead about 30-40 meters away and there was a cyclist on the pavement coming up towards the crossing about 5 meters away from the crossing, so the girlfriend started to slow down in case the cyclist wished to cross. The cyclist didn't show any signs of wanting to cross and indeed went past the crossing when the girlfriend was about 10 meters away from the crossing, at this point she was probably doing 10MPH in anticipation of having to stop, as the cyclist has gone past the crossing the girlfriend has just started to accelerate, however about 3 seconds later after going through the crossing and being around 10 meters past it the cyclist without looking suddenly starts trying to cross the road about 7-8 meters in front of us. Thankfully the girlfriend had probably only got up to about 20MPH and was very quick to apply the breaks and managed to stop in time, the cyclist was still in the middle of the road waiting for the over lane to be clear and suddenly looks at us with a surprised expression realising how close they've been to being knocked over and then suddenly just falls to the ground.

We both get out thinking the cyclist has fallen over as they were just trying to keep the bike up without putting there foot down waiting for the over lane to be clear and in the surprise of almost being knocked over just fallen off.

The cyclist then starts shouting at the girlfriend saying she's knocked her off her bike, we both reply that's not the case and we stopped in time, I still got the sense from her that she still thinks she's been knocked off and ask the cyclist what the hell she thinks she was doing just jumping in the middle of the road, the cyclist then responds that it's a zebra crossing! I point out the zebra crossing is actually 10 meters behind us but she keeps repeating herself and by now demanding we phone the police. The girlfriend does actually proceed to ring the police who turned up with an ambulance! Me and the girlfriend both explain the situation to the police officers whilst the paramedics are treating the cyclist, explaining that were sure we didn't actually collide, the cyclist was on the pavement then just jumped out etc.


The girlfriend got breathalyzed and her details checked and gave a statement by which time the cyclist is walking about fine and seems to of been given the all clear with no injuries present, the cyclist is then demanding my girlfriend gives her, her insurance details and the police just hand them over! Anyway, the police were happy for us to go and I drive the rest of the way home with the police talking to the cyclist.

Now the girlfriend is worried that this cyclist is just trying it on, there's no way she hit the cyclist, if she did surely the cyclist would have gone down straight away, not hover for another 2 seconds before going down, not forgetting the cyclist just jumping in the middle of the road without looking.

There was no damage to the car or bike but the cyclist has her insurance details, what's the chances that the cyclist is successful in claiming?

I said to her about 6 weeks ago I'd get one sorted for her but I just haven't been arsed researching what to get etc, if she remembers I said that she's gonna go nuts at me saying if I'd done what I promised to do this wouldn't be a problem.

I'm not sure it was premeditated though as the cyclist did look very surprised when she saw us, it's obvious she's trying to scam now though but I think she's only thought of it after she's realised what's happened, or she genuinely thinks she's been knocked off.

The cyclist should be bloody grateful that she didn't actually get knocked down, it's lucky that my girlfriend is fairly hesitant and accelerates slowly, I think if it was me I'd of accelerated sooner and harder after realising the cyclist has gone past the crossing and therefore might not of been able to stop in time.
 
I don't imagine there's anything around with CCTV, were still enquire about it tomorrow though.

BTW, should the cyclist have been breathalyzed? My girlfriend is worrying about the police officers now, what they've put down on their report etc as unfortunately in the past the cops have monumentally screwed her over unfairly in a similar situation.

There is no evidential value in breathalysing a cyclist, so there is no point doing it.

You can only be in charge/driving over the prescribed limit in a motor vehicle.

You CAN be unfit through drink or drugs on a mechanically propelled vehicle (IE a pedal cycle) but this has to be evidenced by the officer through other means and generally is corroborated by a force doctor.

The police will only report on what they can ACTUALLY see at the scene and take an account from involved parties and witnesses. They cannot actually report what HAS happened because, they were not there, and do not know. The fact there was a zebra crossing is irrelevant to the cyclist and a weak 'excuse'. Was she intending to ride onto the crossing whilst travelling on the road/pavement? Despite the fact it is some distance behind the 'scene' the following still applies (Unless it was a cycle only crossing)

Highway Code Rule 79:
Do not ride across equestrian crossings, as they are for horse riders only. Do not ride across a pelican, puffin or zebra crossing. Dismount and wheel your cycle across.

There were 2 of you in the car. There is 1 of her. Unless there are witness accounts that corroborate her version of events this will be recorded only and go nowhere prosecution wise. The insurance is a civil matter and up to the insurers and insurers alone.
 
I think this is one of the instances where you should refuse to provide your insurance details and just give your name and address.

I guess you need to wait it out.
 
Unbelievable, I hope that cyclist gets what's coming to her. I hate people who do things like this, sounds to me like your girlfriend did everything perfectly correctly and the cyclist is trying to get a quick buck. I really hope everything works out for you mate (and your girlfriend), were there any witnesses who saw what happened, or was it just you and your girlfriend in the car and the cyclist?
 
Why did you give your insurance details? Surely if there hasn't been an accident then you are under no obligation to do so?

Also, was the cyclist riding or walking on the pavement? If they were riding, I'd make sure to mention this to the police, probably nothing will happen, but she may get slapped with a fine :p

I'd have instantly called her on a scam and sent her on her way, as long as i'm 100% sure I did not hit her at all.
