Girlfriend almost hit a cyclist

It's not so much the time saving though. Sure, that must be nice - but it's common decency. Why should cyclists expect to be treated as equal road users if they don't have the respect for red lights, for example?
if they stop at the red light then they show respect for the red lights.

if after they dismount and carry on as a pedestrian until it's safe to rejoin the road how is that disrespectful ?

Of course there is. Whilst there may not be an attached power to require a specimen of breath or a statutory limit to work with, getting the cyclist to voluntarily give a breath sample could have significant evidential value down the line. If the cyclist was steaming drunk it may have gone some way to proving the OPs story.



A pedal cycle is not a mechanically propelled vehicle. There is an offence under some section of the RTA that is specifically "riding a pedal cycle whilst unfit through drink or drugs" though. There is also one under the licencing act which is something like "being drunk in charge of a carriage in a public highway". :)

Quite right regarding the correct Section of law (Our jurisdiction covers it as a vehicle, UK seems to limit to mechanically propelled) Same difference however.

However, I would still argue that a road side breath test has no evidential value. Depending on constabulary the roadside screening device will not even display a read out. Merely Zero/Pass/Warn/Fail.

The statutory limits are set in law for use in the Prescribed Limit for Driving Law and that alone. While it's very easy to draw comparisons (and arguably potentially useful) it stands for nothing in actual law. Someone can blow double the limit and still be perfectly fit to ride a pedal cycle. You cannot infer they were unfit by a roadside screen result. Not even a roadside screen test is evidential beyond a screening device when used for motor vehicles, which is exactly why a station sample has to be taken on an evidential machine.

If you want to be really really anal about it a breath specimen result is not even a real test of drunkenness. I've seen some functioning alcoholics blow into the 80s and not even present as drunk. It's just a scientific measure of the proportion of alcohol in a given sample size.
 
I don't see how a driver can be found at fault in this incident.

Cyclist illegally riding on the pavement, fails to indicate their intentions to join the highway and indeed cross the lanes, pulls out in front of an oncoming vehicle.

Even if the OP did hit her, it's a claim against the cyclist surely?
 
Should've just told her "ok, I'll call the police. They will see from the dashcam footage from my car that you're scamming"

Doesn't matter you don't have a dashcam..She doesn't know that.

Then angrily state she's a scummy excuse for a human being !
