So i made a mistake when the 2080ti's had just launched and went with a certain scam retailer as they had stock of the card i wanted.

long story short there is something wrong with the cooler where every so often fan 0 ramps to speeds above manual control and i honestly wonder that my case isnt on the other side of the room. Its an intermittent fault but will certainly be putting stress on the fan let alone what is causing it.

Sent it back for RMA and after numerous botched tests telling me how the card hadn't crashed (fan noise problem) i eventually got them to actually sit next to it during a high load situation and was told how they had seen the fault and reproduced it, all good i thought.

Next i get told its got to be sent to MSI in Poland for repair, wasn't happy but we always seem to have crap rma situations dealing in computer components , so off it goes. No feedback for 3 weeks despite numerous calls and promises from the retailer to give updates.

call today , get told it came in on the 10th but nothing had happened and they would chase it up , get an email later in the day saying MSI didn't find it faulty so have returned and the retailer is trying to wash its hands of the matter,

What are my options here ?

TLDR : MSI couldn't find intermittent fault but kept it for 3 weeks retailer confirmed fault and now its been returned to retailer and they don't want anything to do with it.
 
Your contract is with the retailer, not the manufacturer, and the retailer has already admitted it's faulty. If they can't fix it, they are obliged to offer a refund or replacement. If they won't do that, then look to get a chargeback done on your credit card.
