A couple of days ago I (well, my dads email account) received an email from BT explaining that they had received our order and we're transferring us onto Total BB option 3 next week and we would be getting a Homehub through soon.

We're currently on the old Option 4 package and I was planning to move us over to ADSL24 at some point, but now it seems that BT have phoned my dad up and convinced his non computer savvi mind to switch to a different plan that is slightly cheaper (but more expensive than ADSL24) and will presumably be on a new 12 month contract that we are locked into. All from one phone call.

Does anyone know if I can cancel it before the activation date without penalty; after all, nothing has been signed and I doubt my dad was fully aware of what he would be tied into for another 12 months.

Thanks

yeah call them as U have a cooling off period aslong as its done soon & the people U speak to need to be told that the agreementwas entered into not by your dad but another housemember or you were caught whilst busy.

14 day cooling off period, request your mac code whilst your at it it can take a couple of days for them process it (supposedly) ;)

Surely if he's accepted a package after being cold-called, he has rights under the distance selling directive etc.

Distance Selling Regulations

If you sell goods or services to consumers by:
  • the internet
  • digital television
  • mail order, including catalogue shopping
  • phone
  • fax
then you need to know about the Consumer Protection (Distance Selling) Regulations 2000.
The key features of the regulations are:
  • you must give consumers clear information including details of the goods or services offered, delivery arrangements and payment, the supplier's details and the consumer's cancellation right before they buy (known as prior information)
  • you must also provide this information in writing
  • the consumer has a cooling-off period of seven working days.
From The Office of Fair Trading.

Yes they do have 7 days. From point of call the new package starts on the 7th day so once its active, you are bound by the agreement.

Well the OP says they're not getting activated 'til next week. Since he hasn't come back yet, we'll just have to wait to find out how long it was since the sale took place :D

Why don't you want BT, out of interest? Their phone/vision/broadband package on option 3 is good value and I have no problems with the broadband. I don't use torrents but otherwise I am a download user and have had zero problems. Leagues above Tiscali we used to have.

Anything next to Tiscali will look good. Try a proper ISP and you'll soon see BT's faults.

What are those faults? I get solid 500kb/sec minimum HTTP download speed 24/7, no connection dropouts, and I can play trackmania online without proxy tunneling. I'm a happy man.

I'm not cancelling BT (Yet) I just don't want them getting my Dad to sign up for anything that will tie us into another 12 month contract.

I also had some problems with the net a few months back and the support was a bit crappy; i.e. having to repeatedly tell someone in Mumbai, or thereabouts, that I had done all the checks and that I didn't have a BT master socket wasn't fun.
