GTX460 not performing?!

So I got a 460 the other day and it seems it isnt running aswell as it should in Black Ops (extremely low frames, especially at the start of a game and surprisingly in the menu!).

I just played a quick match and I was getting an average of 60fps, but had lows of 35 at times.
I had Afterburner running and apparently my GPU usage was only at a high of 43% and at about 37% most of the time.
I know BO is CPU intensive but surely it must use more than 40%, no?!

I turned AA completely off yesterday after getting unplayable frames and that match I just played was played without AA also.

Before my match today I downloaded drivers 258.96 because I heard they were the most stable (yesterday I had 266.?? or whatever the latest ones are).

Any help is appreciated guys :)

EDIT

I got a Phenom II X2 which I am unable to unlock by the way.

Its fine in all my other games (including CoD4).

So its probably the game then?

It sucks though because when I first installed my card and joined a game I was getting 80fps average (that was with everything on/highest).
That is what made me ask here.

even at stock speeds my 460gtx running on my q6600 with ddr2 ram runs BO just fine 50-60 fps all the time on full settings. i'd imagine the cpu is the bottleneck here

edit: this is on my 1900x1200 samsung btw not a 17inch screen :)

second edit: still seems strange that while working fine at first its dropped down, they havent released any new patched for black ops recently.... hmm....

Yeah, thats whats annoying, im only playing at 1280x1024.

Id be happy with those frames if I was on a HD res. or somthing.
I mean, its DX9 for christ sakes!

Guess I will have to get a new CPU sometime soon then.
Thanks guys :)

Another thing to check is the clockspeed of the card. 460's have power saving by default. They should idle around 50mhz, then ramp up to 50% of the top frequency when you first load the game then ramp up to 100% speed. If you see any drops in the speed in Afterburner while playing a game there could be a fault, though it's unlikely if it's just codblops. The card will clock down in non-intensive sections of a game, for example in menus and front end screens, so that's normal.

I had a problem with Just Cause 2 on my 460 where it would clock down after a while to 50% and the frame rate would collapse. Turns out my PSU wasn't supplying enough juice. I've since built a new system with a better PSU and the problem went away.

Black Ops runs fine here - I sit on the 90FPS limit solidly, and I can't say I've ever seen it move from there, either.

That said, the biggest impact with Black ops was my CPU upgrade - on my old C2D/4890 it was unplayable, however the move to SB/4890 it was playable, but not amazing frame rates. Now with the 6950/70 I have everything maxed out and still get epic frame rates.

I got a MSI Cyclone 460, so its overclocked by default (although that isnt the reason I bought it as its only slightly).

Im going to just put it down to the CPU as if it was the card my other games would be running badly as well.

Thanks for the help though guys.

Try turning off v-sync and in the game press the ` key to bring up the console, the type:
/cg_maxfps 125
(or it maybe com_max fps)

See if you get better frame rates.

Black Ops was the same for me until, I updated BO's to the latest January patch.

BO's runs fine now at 2560*1600 on a gtx 470 and I'v recently switched to a GTX 460 which runs it fine as well.

V-Sync isnt in the options menu, there's 'Sync Every Frame', which is off.

And I capped my frames at 125 when I first got the game, its how I have always played.
