OP is to blame just because he's on the road? Oh come on!

What if you walked across the road and someone drives down to hit you. It's your fault just because you're on the road?! :rolleyes:

You haven't read OP's post that the driver reversed into the crowd as they were waiting for the taxis! If there are crowd around or near my car then I would make sure that no-one is in my way before moving out!

If there was a crowd blocking the path for the driver to reverse out of the bay, how exactly was he supposed to get out? This is one of the reasons I always reverse into a parking bay if I can, but if I'd driven in, in this situation, I'd probably have pulled out slowly after revving my engine to get the attention of the drunks.
 
The Highway Code states that before reversing you should Look carefully before you start reversing and that you should check there are no pedestrians (particularly children), cyclists, other road users or obstructions in the road behind you.

The point here is you could have been a bollard, a parked moped, a blind/deaf/unconcious person or a kid in a pushchair.

He didn't look and he ran over you so he's in the wrong.

Damn straight he is. It most certainly needs to be reported to the police, whether or not you take it further (I would definitely consider it), is down to you.

The guy sounds like a right tool and deserves some punishment in some form IMO.
 
Definately his fault, if the situation was the same except he knocked a child over would this be the childs fault...........? Its always the driver that has to maintain that it is safe to move the car, by the sounds of things he didnt check his mirrors before reversing!

In that case he should have noticed that someone was behind him and kinda asked him to move. Just because he cannot get out of the parking bay does not give him a right to run over the whatever is behind him. Thats not how i was taught to drive anyway:confused:

Also, i would have filed a claim against the driver purely on the basis on him not driving me to hospital and dropping me off halfway despite being at fault:mad:
 
the law doesnt look at it like that.

it is the drivers responsability not the pedestrians. hence if someone runs infront of your car and you hit them - you can get prosecuted.

the onus would be on the court to proove

A) you weren't paying attention

B) you did have enough time to take evasive action or stop but you didn't


C) you were ok to drive (ie glasses on (if required), no alcholetc

D) you weren't driving with excessive speed for the road conditions.

The onus is not on you at all.

Compenstation perhaps is something different.

All accidents resulting in injuries must be reported so the driver broke the law.
