heatskink problems

i put my case on its side and using core temp got 40-50 degrees but when standing up im getting 80-90 degrees
load is between 0-10%

ocuk want it back i presume to RMA it the heatsink is a akasa venom and i5 750 overclocked to 4.00ghz by ocuk

any ideas how i can fix this without sending it back?

You could try reseating the Heatsink as it sounds like it has just come loose but I would check with OCuK if you are ok to do this first.
