Helmet cam evidence

I filtered over a solid white this morning to get to the front of a set of temp lights, even though I had a clear view that the road ahead was empty I still felt like a naughty school boy.

You're allowed if what you're overtaking is going less than 5 or 10 mph if I remember correctly.

Isnt it only cyclists and highway maintenance vehicles?

Highway Code said:
Rule 129

Double white lines where the line nearest you is solid. This means you MUST NOT cross or straddle it unless it is safe and you need to enter adjoining premises or a side road. You may cross the line if necessary, provided the road is clear, to pass a stationary vehicle, or overtake a pedal cycle, horse or road maintenance vehicle, if they are travelling at 10 mph (16 km/h) or less.

Laws RTA 1988 sect 36 & TSRGD regs 10 & 26

So having a quick read through that, it looks like if the traffic is stationary or moving at <10mph then you can cross to overtake. However, I think the key word there is 'if necessary'... but then I don't know how the law actually reads that?

It was cold, wet and I wanted to get to my warm dry office. I'd say it was a very necessary action :D

We have a few policemen on here don't we? Why not ask one?

Failing that I'll ask one in my travels and relay the reply

I'm not sure if 2 years jail time is appropriate to be honest, a horrendous, and I mean horrendous fine and a driving ban would make him think again imo.

Agreed :D

Would still love to know the actual legal view on that though.

For example, let's say the traffic was stationary and I decided to filter, passing over the solid white line. Then, ahead, a car suddenly decides to start a u-turn without looking or indicating and I can't avoid going in to the front side of him. Who's at fault?

you are, your not supposed to cross the double white lines no matter what, only if filtering and you can stay within the white lines

But the highway code rule 129 says differently. I'm just not sure if the 'if necessary' bit is the key word there as it says if the car is stationary you can pass it...

Yeah, that'd be good if you could ask :). I don't know who the police are around here, so not sure who to ask? Saying that, I think the opinion would vary between police, these things always seem to be that way. I would want to know from an actual legal point of view as the wording is confusing.

If anything comes the other way your gonna splat all over it like a fly, most double white lines are on blind bends so idk why you'd wanna cross them at all, unless your tired of living

This is no laughing matter :p this actually happened to me on the way to work one day. About half way to work I was about ready to explode, luckily I made it with the worst stomach cramps.

I can relate to this. The journey from the car park to the bogs feels like the longest walk you've ever done :D

Don't some cams come with a "QUICK WIPE!!" button I'm sure I've heard? If not I should patent that idea.

Soon as the blue lights go on wipe it, hell just take out the memory card and launch it in the bushes!

It is a worry this, I dont ride like that guy of course just plan crazy but at times I may pop the odd wheelie where appropriate :) He was made an example of for sure and the sentence is cruel imo. I'm starting a petition, "free that guy who recorded himself" "free that guy who recorded himself" I will get the banners made up!
