Help me with my rights (Used Van Issue)

Hi guys,

Right here is my problem, I bought a VW T5 Transporter Van roughly 5 - 6 weeks ago. Today when driving the van I noticed a very loud whine in 5th gear, while nothing has failed as such yet I have done some google searching and it turns out to be a regular issue with these gearboxes eventually causing gearbox failure. I purchased the vehicle from a garage and says on there website 3 months or 3000 miles back to base cover which I am under so am I well within my rights to get them to inspect/repair it? If I have issues with them where to I stand then? I paid nearly £4k deposit on my CC and the rest is on Finance so could I get them involved? First step is to ring the dealer obviously, but want to arm myself with my rights/facts before doing so as I am normally a push over on things like this. Cheers!
 
Between 30 days and 6 months
If a fault comes to light after 30 days but before 6 months have passed then you are entitled to a repair, replacement or refund. It is assumed in law that the fault was present at the time of purchase unless the seller can prove otherwise. During this period, unless you have agreed otherwise, the seller (dealer) has only one opportunity to repair (or replace) the faulty vehicle after which, if they fail to repair it, you are entitled to a refund.

In the event of a refund following a failed attempt at repair during the first six months the seller is permitted to make a 'reasonable' adjustment to the amount refunded to take account of the use that you have had of the vehicle since you bought it.

Just to keep you updated, I went to the garage I bought it from today, they took a test drive, confirmed what I had said and are having it in Wednesday to remove the gearbox and check it over! I was pleasantly surprised considering all the horror stories you read on the net these days! :D

You only ever hear about the bad experiences.
