So ill start with system specs.
Intel 10700k
32gb memory
Rtx 3080

So my issue is massive frame drops in game using streamlabs obs, im talking going from average 180fps in modern warfare down to about 110fps when opening streamlabs obs.
Im using nvenc new, if there are any other settings you need to know please let me know, this really is causing me a huge headache cause i spent a ton of money on this rig and i just dont understand whats going on as i should be more than capable of not dropping frames.

I'd argue the 'Graphics Cards' forum section is not the right place to ask this kind of question, but what do I know.

Something to try, you can try to claw back some frames by turning off the preview window. To do this, right click the preview screen window (the main window that shows your game and stream) and click 'Performance Mode'. I've personally seen improvements by doing this on certain games where I can see stuttering.

Alternatively you can build a secondary stream PC with a new capture card like the big boys in broadcast-land, but that's going a bit over the top.
 
Then you're encoding on the GPU, so no wonder you're getting lower framerates. Why are you worried anyway as you're streaming?
My understanding is nvenc shouldnt impact gaming? Or am i wrong? Especially such a huge drop on a so called top of the range card. Why am i worried, beause i dont want dropped fps to impact my performance

You're using the GPU for something other than pushing frames. Of course it's going to affect performance. On review, I am surprised by the amount you're losing; I would have expected 10% or so, not 30%. Are you using a NVME drive, a SSD, or a HDD? What are your OBS bitrate, framerate, and resolution settings?

tbh I have a 9900k and always encoded using the cpu and leave the gpu for playing the game etc. It never breaks more than 38% max usually around 22-24% at 1080p 60fps on the stream.

So i tried this yesterday, putting everything on the cpu and still dropped massive frames, i dont a bit of testing with all settings low 1440p i was averaging 190fps not streaming then with streaming all low settings i was averaging 110fps with or without using gpu to encode, something clearly isnt right

You might want to look at your bit rate, you can lose frames if your bit rate is set too high and you upload speed can't cover it. (stream side obviously)
