Does seem a little warm, but you are at 4ghz when running full load, what case do you have and air flow.
Does the cpu speed up when temps increase.

Yeah that is about right for that cooler I suspect. You can play with your voltages to fine tune and should be able to bring them down a little. But not by much. Understand that the 1136 CPU's are rather warm once voltage is added. :D

I changed the bios so now im constant at 4ghz anyway,
im using a nzxt phantom with 4 120mm fans and 1 200mm on the top.

I also remember not leaving the cpu cooler screws not that tight as i thought it might damage the mobo, that was probably wrong am i safe to just tighten them now or should i reseat the cooler first?

You're temps look fine to me. You'll never reach those temps anyway whilst gaming so I honestly wouldn't worry about it.

You're right not to over-tighten the screws on the cooler. I'd leave it as it is to be honest.

Gonna try reseat it anyway temps just seem to high for my liking ive seen stock coolers getting my temps, i would feel a lot more comfortable having below 70 degrees at full load.
