Hit someone and a question as to fault?

Was following someone on a normal 30mph main road. Bake lights come on for no reason, he slows down, so i to pass him. He then turns right across and into me so i hit his rear wheel and rear quarter after locking up wheels.

He said he indicated but when i asked him to show me the rear indicator didn't work (his mum claims it worked before the accident).

Now as it stands it wasn't his fault if he indicated, but it wasn't mine i don't think as he didn't indicate.
Was a fault of his car.

Am i going to be bent over? :(
 
Thought so. Cheers guys. What about mirror, signal, manouvre? Seeing as ha missed 2 out of 3 lol. Not being nasty about it with him. Just not as clear cut as simply running into back of him.

Live and learn. Next time someone brakes for no reason with no indication I know to sit behind them til they get out lol.
 
No worries guys, I'm not out to stuff anyone - was only asking a question.
There were loads of little questions but I've told my insurers what happened to the letter so we'll see. Worst case my insurance doubles, best case he wasn't insured and gets found out. He was a young lad in a pug with boyracer exhaust and mum in passenger seat who (trust me!) did all the talking lol. Felt a bit sorry for him as think he may have been out on a provisional as his mum (think it was his mum) was in car. No L plates or P plates so I'm just assuming on how quiet he were.
Ah well. :)

wasn't sure if the things you are taught in your test apply in the real world. they're not so my mistake lol. :)

i'll wait and see.

Fox - i realise that but if the has no insurance he may think twice about it as i'd expect to deal with his insurance company in the claim stakes?
 
I wouldnt say 100% fault if the indicator wasnt on, however if this was a safe overtake then it wouldnt have happended an I would imagine that there would have been visibility of the side repeaters.

Out of interest op, did you signal before you overtook and what gear were you in?

i had started braking and the shunt wasn't that hard so maybe 20mph tops before i braked and locked the wheels up? i was in 3rd or 4th gear but i often drive around in 5th from 30mph+ and i can't afford to cane it with petrol prices lol.
 
Yes im afraid.

Overtaking near a junction is a no no, will go in his favour as the liability is yours.

@OP: Just to clarify he was turning into a junction right? I just noticed you never actually said that other people just assumed it. If he was turning into a driveway or starting a 3 point turn or just generally swerving across the road for no reason its a different kettle of fish.

Yeah, he was coming up to a right turn on a straight, clear road so yes i was stupid but hey.... it's why we pay insurance i guess. ho-hum. :)
