HMV warranty

First off, not sure if HMV is a competitor? If it is it wont be for much longer :p but mods please delete if inappropriate.

So i bought a pair of headphones in store in February and now the left one has stopped working. It diddnt "start to go" so i dont think its a loose connection in the wire (its also been taken care of pretty well). So I go in yesterday with receipt expecting an easy return... it's not to be, I'm given some BS excuse that i "didn't buy the warranty" and so its not covered. Supposedly at the time i was offered a warranty for £2.99 which would cover them for a year and because i chose not to pay, theres no warranty covering them.
Now, is it just me or is this utter ****? I thought that it was EU law that electrical items had to be covered for a year? Is it just because im used to the lovely people at OCUK?
 
Even if they won't give you the warranty, ultimately the manufacturer of the product you will have warranty with.
 
Maybe just a crap member of staff you spoke to, contact the manufacturer as mason said, and they should replace/repair them without too much of a hassle

Nothing strange about this as far as I know. You have a warranty with the manufacturer, not the retailer, so go direct to them.

You have nothing by law with the manufacturer. You have a contract of sale with the retailer and under the Sale of Goods act they be bound.

Go back into HMV.

Indeed, you have a right to a remedy under sale of goods act 1979, specifically section S.14(2) - the headphones are to be of satisfactory quality.

As they were purchased less than 6 months ago, the law assumes they were faulty on purchase if they break within 6 months.

Go into the store and cite the above - you will most likely get a replacement.

How expensive were they?
 
I think in that situation I would have politely asked the HMV member of staff to bring over the manager for they themselves were communicating verbally from their external anal sphincter.

yeah, £30, i got the O'neill/Philips "Specked" ones specifically because they were suppossed to be robust :p my advice, dont buy a pair, not only have they broken but they were quite disapointing when they did work, because the cable is some weird textured fabric the noise created by it rubbing against clothing is HORRIBLE. They did look pretty cool tho :p

Heh, I had a pair of headphones I bought from HMV fail on me last year after a few months as well. The staff member also tried to tell me I had a contract with the manufacturer and not HMV (!), which did not impress me.

He was not willing to listen to basic contract law principles either, but after speaking with the manager I got my pair replaced under the SGA 1979.
