Holiday Entitlement Help?

Started a new job on the 31st May this year. Leave is from 1st January every year. SO am I right in saying I am entitled to 16.33 days leave? My employer includes bank holiday in the 28 days leave. So obviously thats 16.33 days - 3 days remaing bank holiday this year totalling 13.33 days. How does the 0.33 days work, does my employer have to round it to say a half day?

Also if the work place closes for a week over Christmas am I entitled to pay without taking holiday?
 
Hmm, that's a good question. Tbh, if the Bank holidays are included in the 28 days holiday then that is 20 days per year + 8 BH

So with you starting on the 31st May I would calculate your holiday as the pro rata of the 20 = 7/12 * 20 = 11.66 days

I would be very surprised if HR calculated pro-rata holiday dependent on the date someone started and how many BH's had already gone that year.

I may be doing it wrong and illegally, but there are so many grey areas when it comes to working out Hol Entitlement! :D



You are not entitled to that no, the employer is entitled to tell you when you can take your holiday, for periods of shutdown such as this.

But you can always request it and negotiate with your employer to see if they will let you.

I was calculating it at 28 days in a year. Obv if that includes bank hols it doesn't matter it's still the min. I didn't take into account prev bank holidays so 28/12 x 7 = 16.33 then - 3 remaining bank hols. As if it's 20/12 x7 surely that puts me under the the legal entitlement?
