Could Microsoft prosecute a business for using Office in a commercial setting if it was Home and Student?

And how could they prove it?

Yes they could take out a civil case for breach of license conditions. Against whom I am not sure.

Evidence from the users in the form of affidavits.

Would they? Highly unlikely.

Yes they could. Generally they only audit large organisations with volume licence agreements, but if you're small then it's unlikely you'll get caught.

It's more cost effective to pirate though
