how to dx mode in crysis

I'm running vista 32bit with a hd3850 graphics card and i've run the bench mark tool and the difference between DX10 and DX9 is over 10FPS is there a way to change what version i can run or is it defaulted to DX10 in vista.
 
Right click on the game in games explorer and select Run in DX9 mode.

edit: Alternatively you could create a shortcut and add -DX9 to the command line.

You can right click and customise the order for the icon, so play dx9 is first, double clicking or clicking "play" will then load dx9 version. The benchmarks all seem to run in dx10 for me so I cant copare it like that, but find yes, an extra 10 fps from dx9 with very high config settings.
