I-pod 20gb crashing

I recently purchased one of these from an aquaintance. Its about 6 months old acording to him. Ive been having a few problems with it crashing midway through a track. Is this a common problem? would a software update be any help? Is there a chance it could be caused by me having it in my trouser pocket (shock to the hard drive?) Its a pain in the ass cause if it happens on my way to work i have to wait for the battery to run down as none of the buttons do anything, Leaving me without music all day!

Any help would be apreciated as i may have to get the guy to give me my money back! (Starting to wonder why he sold it to me for £50 now!)

ok are they likely to replace it without the recipt? i have the box and everything that goes with it but as he was a rep he got given it for free....
