I'm not thinking just yet but could i drop an I5 into my pre OC'd set up without it messing up my OC,or would i have to re-OC it myself? (the pre OC bundle was from OCUK)

Stick with what you got. The overclock setting OcUK used would only works for your current set-up, and also the i5 750/i5 760 doesn't overclock well on the H55 chipset board. And i5 750/i5 760 ain't gonna improve your frame rate in games with just a 9800GT, except for ridiculous CPU hog like Black OPs.

No, you would need to reset the CMOS when you insert the chip anyway to ensure no problems.
You would need to re-do the overclock, and stability testing etc.

And: Your sig is waaay too big. 4 lines maximum. Its all in the FAQ!

why not have you sig as....

i3 540@ 4.20GHz : Motherboard: Gigabyte GA-H55M-UD2H
Corsair XMS3 4GB (2x2GB) DDR3 : 9800GT

...will read the same to us on here and keep within forum guidelines

The other issue is OCUK staff reported problems overclocking a quad-core on that little UD2 mobo as it has no heatsink on the power devices and basically fried. Your i3 setup will be fine for a good while yet until a full mobo/CPU swap to future kit - Sandy Bridge/Ivy Bridge/Bulldozer.
