if an iphone is locked to tmobile?

I am looking at iphones atm on ebay , and some are locked to say tmobile and owners only had them a month or so , what i am concered about is if i buy it , and that phone is still under contract to the person i bought it from , and they stop paying for there contract does that mean tmobile can black list the phone and i am screwed?
 
Technically the phone comes after the contract. Meaning the contract is for the included allowances and the phone is yours to do as you please.
