Not if the ownership of the intellectual property was transferred.

I suppose it would depend on the terms of the sale, Mr. Jim. I reckon that with no other terms other than "I'll give you this pretty picture if you give be a hundred bucks" the purchaser would own the IP rights and would be able to make copies.

Not if the artist lives I believe.
 
It's not just Original Paintings - the same goes with photographs.
We recently were married, well back in October last year.
We had a photographer who captured the day etc.
Part of our package included 30 prints of the numerous pictures taken and a copy of all our pictures on a DVD.
However as standard we had no rights to distribute those images - they were for our own record, however we held no other rights.
If we wanted prints etc from a legal point of view we had to go back to the photographer and ask ker to sort them out.

For £200 we could purchase all rights to the pictures and then we were free to do with them as we pleased.
Even then the photographer retained the rights to use any of the pictures in her professional portfolio - although she did then have to ask our permission if she wanted to use any of them on her website.

Artists, photographers and the like are very protective of their work and if you are ever purchasing anything from them you really do need to check just what rights you are also purchasing.
