I'm sorry...Ebay Faulty Item Query

Purchased a exercise bike from Ebay from a pretty reputable seller ( 2000+ auctions green, around 15 greys ) and when setting up, the thread on the pedal on one side is shot as it moves to a bad angle after three or so turns and moves no further, I did use a little more force than normal on the second attempt, like anyone would with new unused thread as it even the other side was stiff when fitting for the first time.

The major problem being it's a present for Christmas day and the seller is currently trying to pin the blame on myself trying to force the pedal in and therefore causing the problem.

I can see where this one is heading, and although I can swear on the bible this was in fact a build problem not a user error, I'm wondering what I can try and do to get this item replaced asap, in fact in time for Christmas.


Oh and added bonus the item is so heavy the cost of delivery is £30 on a 48hr postage.
