Image differs from description...

Ok who is in the wrong here, If an online seller uses the image of a red item on both there sites but describes it as blue.

Is the image more important than the wording or not? Also there is no indication of colour may vary or may not reassemble that shown.

For an online retailer, I'd always go by the text.

For eBay, it's pot luck. Sometimes the pic is wrong and sometimes the text is wrong.

Legally, I expect the text is the binding bit.
 
emmm not good basically I ordered a polo shirt.

red bottom row middle " red blue fleck" then two rows above it actual blue fleck

Then there eBay same deal

If it had been me ordering, I would have expected the item as pictured from this page to be delivered as pictured:

If what you got wasn't red, then I think you have fair grounds for a return and refund of shipping, because its not as described. Its clear they haven't managed the control of those two items very well.
 
Conversely to Nexus, I would expect an item where I have a colour selection box that lets me select 'blue fleck' to arrive as blue fleck regardless of stock image attached. (Or just not bother if I felt there was that much doubt)

Stock images are horrendous for being wrong on shop websites, I pay no attention at all.

Just return it under the DSR if you don't want it, i'm guessing you probably haven't even opened it. Doesn't matter why you want to return it if it's a DSR return.

The fleck bit makes it sound a bit more ambiguous, compared to if it full on just said blue. Even though there is a drop down box for Colour, many websites will have such things because of how they are setup, regardless of whether there is only one colour, for example you often get one size items with a drop down menu for size.

At the end of the day though, we have both pointed out the obvious. If its not what you expected, you are well within your rights to return it.
