We're about to embark on a geographical photo tour and was wondering where the law stands on using premises/business names in images that are then used by a national company for commercial use.

I'm aware that some locations require a location release, but for example a photo of a pub (outside, taken on public property) is then used in a national ad campaign, would they have any ground to suggest that they were using the image or name of the pub to promote, or possible insinuating that the pub were endorsing the company?

Thoughts welcome!

Could be the coffee hasn't kicked in yet but i'm getting confused with the above that is bold. Can you reword for my feeble caffeine deprived brain!

Just to add i don't think you'll be able to use the images as described (if i understand the usage correctly).

Logos, brands etc. afaiui can be incidental in an image and used without copyright or trademark infringement. But if the logo, brand is prominent or likely to lead to confusion that they endorsed, sponsored or are associated with the image or the promotion it is not permitted without licensing / consent.

You can't use anything like that for commercial use. If you search google, the most clearly defined answers come under searches for the national trust. Quite a few links for the laws regarding this, under those results. I can't post the links as I'm at work, but I think I've got them bookmarked at home if you've not found it by the time I get back.

This, you will have to photoshop out the logos for such use.

You need to avoid creating any associations between different bussiness with their logos.
You can ask the businesses for permission and create a contract.
