Incorrect listing on graphics card

If a company sells an item in this case a graphics card and then when the customer receives the card and finds it totally not what he ordered. i.e. picture is wrong & the manufacturers product code different.

What should the company do to rectify this?
 
As far as I know, the seller must supply as described. I would just contact the retailer and check with them. Under the distance selling act, you legally have 7 days to return your goods without any reason.
 
Depends what we are talking about here. If the site was to spec for example a 5870 and send 5770 they must supply the correct card spec. If were talking about the pic was different from their website you dont have a hope as most places will have for Illustration purposes only on their T&C
 
Depends if it was a branded card or a whitelabel shop brand one, usually the unbranded one you get whatever is in stock that fits the description, the picture isn't applicable as they just sell whatever they can get in stock at the right price that fits the spec.

If it was branded, and the wrong spec/prod code, then I'd send it back if it wasn't what I specifically wanted/needed. But if it was functionally equivalent I doubt you would have much to complain about.

e.g. In the past I ordered a 9600GSO that was supposed to be the 192 bit memory, 96 stream processor version but got the same brand, same model name 256 bit memory, 48 stream processor version. So I sent it back as it wasn't what I wanted.
 
So if the product i got in hand is totally wrong from what i ordered on the website. I would expect a full refund and what about the cost of returning the item back? would it mean i would be out of pocket or depending on how good the customer service is from the retailer?
 
Normally if the retailer is in the wrong they will either sort the pickup or refund the postage if you send it back.
 
Thats what i thought but the retailer has only refund the cost of the card. I've been waiting over 7 days for them to sort the issue out and they just kept stalling the refund of the remaining amount owing!
 
Ive also noticed the retailer has not changed the listing to show the details of the actual product you will be getting. So this could happen again to someone else!
 
If the advertise one thing and send another, refund is entirely on them, if its say an OCUK branded 580gtx, AND they added a disclaimer in the product detail saying picture is for illustration purposes only, final cards differ, then theres no legal obligation to provide a specific card, just the correct specs as listed. In general places shouldn't add anything but a picture of the actual card being sent, more than anything because its a lot of hassle if they add the wrong picture.

I haven't checked but as of a few days ago the entire 580gtx's listings were incorrect in half of what they said, misleading and false advertising, incorrect specs and same "speed % advantage" numbers on differening speed cards, which are obviously incorrect.

False advertising is prevelant but it really shouldn't be too hard to push any retailer into a full refund if they made a mistake with the specs.

But in this case i made the purchase via the manufacturers product code which matched the pic they displayed.

Not fit for purpose as I need a low profile card. Although its a 8400gs 512mb, i knew there would be various kinds, that why i researched the Manufacturers code.

I just dont understand why i have to pay for someone elses mistake!
