Incurred a random cancellation charge??

Hi all,

We signed up with Tiscali for TV, broadband and phone back in October 2008 (initial 12 month contract). On the 28th June this year I called up and asked to cancel the TV part of the package which I was assured was no problem and a guy would come round to pick up the box soon. The guy came round and our TV service was cancelled as expected with phone and broadband continuing. All seemed OK until I checked my account today and £50 has been taken by Talk Talk (who now own Tiscali) on the usual payment date. I logged onto the website and checked the bill to discover a mysterious £25.33 excl vat charge on it for "TV setup fee". No mention of this apparent cancellation charge was made when I spoke on the phone to cancel the TV, nor is any cancellation charge mentioned in our TV contract. It only states that they may come and collect the box outside the contract period if we end our services.

Annoyingly, the Ts & Cs state that a written dispute regarding the payment amount must be lodged via post within 30 days of the invoice date on the bill. The invoice date was the 2nd July. :( I'm going to speak to customer services tomorrow but do you reckon there is any chance of getting the money back? It seems extremely unjustified.
