My mate works for a builder's yard. Yesterday he was supposed to work. He basically pulled a sickie.

That night, in his infinite wisdom, he went to his local pub. He bumped into his boss after he'd had a couple of jars.
Next day, to cut a long story short

'Yesterday you were well enough to get to the pub and have some bevvies, so in my opinion you were well enough to get to work, so you directly lied to me about being sick, so you're sacked'.

No warnings formal, written or otherwise, just 'get out now'. He didn't get paid for the day he was sacked but was only there for 15 minutes. Oh, he is (was!) within his 3 month 'trial period'.

He can't prove he was ill with formal doctors notes or anything, just lie more, as between you and me he wasn't actually ill at all.

Worth bothering with industrial tribunals and letters of complaint and calls for redundancy money and talking to citizens advice (or something), or just let it go?

He can be sacked for anything within 6 months.

Anything apart from sex/race/religion/disability, basically.

Has he signed a contract of employment with the bloke?

I'm no expert but seems like hes clearly extracted the urine and probably hasn't got much of a leg to stand on given the fact that he is on a 3 month TRIAL period.

He failed the trial, he got cut. Seems fair to me.

Lying to your boss and taking a day off without permission could quite easily be considered gross misconduct. As he was also in his three month trial period he is pretty much stuffed.

He's only been there 3 months so I'm afraid he hasn't a leg to stand on. He shouldn't have had such little regard for his employer and his job.

So he wasn't actually ill, lied to his Boss about it, got caught and now you're asking if he should lie to an industrial tribunal as well?

Are you asking on his behalf or is it you who has no morals and thinks its ok to lie to the tribunal and steal money from it?

Several years back at my work place someone was sacked because of an incident where a large piece of machinery was dropped and damaged. I won't bore you with the details but the person sacked said he hadn't done it. Security camera footage begged to differ.

It was an accident. If he'd held his hands up right away he would ahve got a bollocking for dropping the machine since the way he was moving it was against company procedure. He wouldn't even have been disciplined.

He got sacked for lying. Complete loss of trust.

It is not me. I work in IT

Not a leg to stand on unfortunatly. Althought if he was stupid enough to go to the pub when pulling a sickie......

Haha, your mate doesn't have a foot to stand on in this situation. I would have personally done the same thing as every bit counts. Think of being in the boss shoes, he'd be an unsuccessful boss if he let something like that slide. But yeah, like Rids said, tell him to take it on the chin and move on and be more dedicated to his job. Or suggest you tell him to try and get in to working at something he enjoys doing.
