Insurance Excess- Not at Fault

As I recently posted my Mum had a minor accident with a moped.

Insurance proceedings have began and I read through an email sent by SwiftCover to my Mum.

They say her excess, £300, is payable regardless of fault.

Is this the norm? We have no idea of the outcome of the accident and who was to blame. I was always under the impression that if the other party was to blame you did not lose excess or NCB?

Check the small print for a specific reference to Excess payments I guess?

It does not sound right to me but god knows what your Mothers contract states!
 
Normally it's the first part of any claim the policy holder is liable to pay to the garage upon completion of repairs to their vehicle - regardless of fault.

However in certain situations the claim may be 'ACED', so that the policy holder's excess is waived before an admission of liability is gained from the third party insurers. Examples being:- being hit in the rear by a third party, or third party out of a side road.

Otherwise the excess is payable to the garage and will be waived if the admission comes before the repairs to the vehicle are complete or reimbursed to the policy holder if after the repairs are complete.

it was the same for my parents when my mum was crashed into in a very clear cut case, this is why i will never go direct through an insurance company, accident management companies all the way!

If you claim against your own insurance rather than the other drivers, you do have to pay the excess, however if it's all proven not to be your fault you will get it back once your insurance company itself isn't left out of pocket.

Happened to me last year, had to pay £350 excess to the repair garage, it was a bit hairy for a couple of months as it seemed no contact was being made with the others insurer, they weren't replying apparently (the other driver was a foreign driver/visiter made it a lot more stressful!)

Renewal was due before it was resolved so with NCB's taken off it doubled the insurance nothing could be done, so had to lump it, though roughly a month after I got the excess back so we got onto the insurance straight away and made sure the NCB reinstated and the price dropped back to what it was originally, all came good in the end but it was a lot of hassle and chasing insurance to find out the progress.

I got told it's always best to claim direct from the other persons insurance, though in my case it wasn't possible because I had no idea who it was.

They exist because insurers allow them to by offering poor service in the case of non fault accidents.

If your insurer didn't treat a blatant non fault accident as a fault case (ie a Corsa courtesy vehicle, excess charged etc) until the cost had been recovered people wouldnt need to use an accident management company.

I'm fully aware of why people use them, but as above they make my life so much more annoying.
 
Chris, this is unfortunately normal. As said it really should have gone through an accident management company :(
 
well, I had a little bump just before christmas in a halfords car park, a guy in a van reversed into the side of me. Got all his details (he admitted liability at the scence) called my insurance and gave them everything, they waived my excess and my ncb are safe :) but because of the holidays and all that it, only went into the bodyshop yesterday. Albany have been brilliant sorting everything out, even got a Lexus IS220 as a courtesy car.
