insurance issues (accident management companys)

My friend was hit in the rear when stopped, other party amitted liabilty.

Knowing that the insurance would give her a naff car i told her to go with accicdent mangement company, europa constulants but when she went to get the details and tell her insurance company admiral (same insurance as the driver who hit her), they told her that she would have to pay any extra for the car because they would give her a car that she was not entitled for.

My point is that she drives a MX5 and the car they would give her is a astra, which is frankly rubbish (on a site note another friend who was in a bump in his celica 190 was also give an astra and is hating it).

I assume they are trying to keep it in house to save cost, and shaft her, but can they do that, I mean its not a comparable car at all, 2 seat sports car to a family hatchback.

Well the 3rd party insurer should be giving a car that is at least equal to the one that got damaged. Are you saying her insurer is trying to keep it in house or the 3rd party?

There's also no real need to let her insurer know since everything is being dealt with by the helpline company and everything is being claimed from the other driver's insurer.
 
Dont even talk to admiral, go thought the other company. Admiral are trying to cut costs but its HIS insurance that had to pay out not hers, the fact its the same company isnt your problem.

Of course they can, unless it specifically states in the policy that they'll give her a like for like car in the event of an accident, which it probably doesn't.

Ok, let the helpline company manage everything, they will (or should) take care of everything from A to Z including arrangement of hire car at the 3rd parties expense.

Both drivers may be insured by the same insurer but that has no relation to her side having to pay out anything or giving a car etc.

But why should she be force to drive around in a crap car when shes payed for a nice one?

my issue is adimiral are threating to charge more to her, for getting a better car, which in my opinion is bull. It should be like for like. If you drove a aston would you be happy in a micra?
 
It sounds to me like she's going through her insurer if her Admiral are wanting to charge her. Why is she doing this?
 
Had similar issues with my crash. I'm with bell s2000 as my car. She was with diamond, so same group. Immediately got in touch with Europa and when bell came asking sent their papers back blank and a letter saying Europa are dealing and to just contact them. Diamond called me about 20 times begging me to go with them. Mike at Europa did the business and it's sorted now. Moral is call Europa first and just do what they say !!

Does it matter? An Astra is hardly crap. It'll get her to/from work and wherever, while the matter is resolved. Then she'll get her MX5 back and will appreciate it.

I guess when you get raped 2 grand for insurance to begin with it kind of leAves a sour taste when through no fault of your own you loose your group 20 hooligan mobile and get a crudbox

In this case (as was mine few years ago) someone hit her, so it's that someone who's insurer will be fitting the bill at whatever the cost comes to because it's their policy holder's fault that she is off the road. In my case I got a brand new Clio which cost £42 a day and had that for a month whilst the 3rd party's insurer took their sweet time at sorting their end out. thankfully I used a help company to do everything and when the insurer came back asking why I was given such a car and that they didn't want to pay the hire fees they got delined showed where to look by the law firm appointed by the helpline company and ended up paying everything.
I didn't need to lift a single finger after I sorted my statement out and gave my details, I just opened letters and answered calls which updated me on the situation.

This is what she should do in the OP.

If the accident isn't her fault, she is entitied to an equivalent hire car for the duration of any repairs. End of story.

You're not losing anything :confused: You're getting a temporary car whilst your "hooligan mobile" is being repaired or replaced.

It does matter, he's trying to argue that Admiral are somehow entitled to give him something better :confused:

She is the 3rd party, she doesn't even need to be insured to be entitled for a like-for-like car. Her insurance policy does not come into it at all. If insureance companies didn't take the **** by offering crap cars than companies like help hire wouldn't exist. It is their own fault this happens.
 
im saying that she should get a similar car, not better and say it took 3 weeks to fix why should some one pay to drive a rubbish car (car tax, insurance,loan etc)?

Err... yes you are. You're losing the use of a vehicle which you have paid (or are paying) for through no fault of your own.
 
Meh. Fair enough, I guess. :p Don't helphire have a reputation of charging ridiculously over the odds to insruance companies though?
 
The insurers (whichever insurer that person uses) then claim some of that cost back from the policy holder at fault on the next premium. Problem solved!

Basically if you're not the driver at fault, you should have nothing to worry about, ever.
