Helphire wil definitely be far easier than messing with your own insurance company: my mum used her own insurance company and her ncb was suspended until the claim had completely been settled and it was generally a lot of hassle. I've used helphire twice and it couldn't have been better, like for like courtesy car within 4 hours and 15 minutes of phonecalls from start to finish.
 
It's definitely his fault but he could lie to claim some kind of 50/50.

If he decides to lie, you won't have a chance and insurance will settle 50/50 without independent witnesses to prove either of you right (you being a passenger are not independent)

Helphire will only help you if the other guy admits liability or liability is easily established (such as a rear end impact)

If he does admit, just go through his insurance and don't let help hire go profiteering off another motorist. The bill they put on my insurance for car hire was ludicrous. They are amongst the companies responsible for putting our premiums up. The sooner these accident management companies get clamped down on the better.

Just to clear things up;

The guy is being a nice bloke and not lying in any way, he's been in the UK with his wife from France for about 5-6 years now and never had to deal with any sort of insurance claim so he's just telling the 100% truth which is very nice.

He's just phoned us to say he's spoken to his insurance company and they've told him "Leave it with us and we'll be sorting everything now", this after we called last night - so I assume he's told them pretty much the same story we did and they've taken it as a fault claim on his behalf.

When we called his insurance company we did ask for a courtesy car as he's hit our car right near the wheel (possible suspension damage) so the GF doesn't really want to drive her car anymore. The door has also had to be taped up to stop rain getting in so you cannot open either the front or rear passenger side door anymore.

His insurance company said - "If you want a courtesy car phone your own insurance company" which I'm not going to do as I'm not gonna get a claim started from them.

We are gonna give it a few hours, then call his insurance company back, if they still refuse then I'll give HelpHire a call.

We really need a car as I can't get into mine yet, and GF is scared to drive it despite being insured. She is also on half term (she is a teacher) so she has the entire week off work, she doesn't want to drive her car and doesn't want it left in the parking space because of rain getting through the tape and it only has 3 working doors out of the 5.
 
Sounds like he's a nice, honest bloke, which I'm sorry to say, is the exception rather than the rule in these situations these days. I'd give them another opportunity to send a car out today, if not, Helphire time
 
His insurance company just called, a company from Guildford is coming to recover my GF's car and Enterprise are going to drop round a courtesy car. We've asked for a like for like (5 door) so that I can get in and out of the car.

Looks like it's all going through his insurance company. I've also told my GF to demand her car is repaired at the local VW garage and not some random garage to save the insurance company a few quid.

Atleast the guy seems to be doing the decent thing, hopefully all will be sorted promptly.

They've taken hamstring from my good leg (left) and used it to repair my medical and cruciate ligaments, they then drilled a hole through my kneecap and fed hamstring through the hole and tied the kneecap in place to stop in dislocating.

The result though because they operated on both legs has left me totally bed bound for the past 2 weeks and unable to really use crutches very well, or bend my bad (right knee). Which is why I was lying across the back seats with my bad leg pushed right up against the door he smacked into!

All seems to be going well in terms of his insurance company getting things sorted quickly though.

I've had enough offers for people to drive the car! Had to get the GF insured on it so she's driving it once a week to keep it running!

Recovery came and towed her car away, it's been taken to a VW approved body shop on the Slyfield Estate in Guildford.

Enterprise have given her a brand new 5 door Megane, which we are happy with considering we were afraid of a dreaded 3 door Corsa which would have been useless.

Just gotta wait and see what happens now then, it might get written off thinking about it. The damage looks like it'll need a fair bit of work to the door and wing, plus the rear door has been moved ever so slightly. New wing mirror, suspension and tracking to be checked and courtesy car costs and we recon the car is only worth £1.5k-£2k.

Damage to his car is probably £200-£300, 1 dent to be pulled and 2 small scratches to be cleaned up.
 
Car is being returned today, partner is at work so I'm taking delivery but doubt I'll be able to look at it due to my injury so will have to sign for it as unseen.

Still got the hire car till the 7th, but GF is going to try and get them to pick it up, they usually like you to drop it back and then they drop you home but she's working till 8 or 9 every night till Saturday (7am start) so wouldn't have chance and I'm still months off driving.

Will do some before and after shots when I can.

Overall I cannot fault how the other insurance company have handled this (Aviva), the only small tiny downside was the first person we spoke to had a very thick Asian accent and they refused a courtesy car to us (although he should have mentioned this was only till they spoke to their client and confirmed it was them at fault). Getting a courtesy car, having ours taken away and fixed has all been very quick and clearly communicated.

Didn't need to deal with her insurance company (Direct Line) so can't comment on them.
