The other guy was at fault but my car is scratched to hell, I want to see this guy fry, I have 1 witness (passenger)

He is with Frizzell, and I am with Direct Line, I aim to claim for whiplash, my car damage etc. I do not want this to go on my insurance claim record eventhough I have protected NCB :)

What procedure should I follow?

You can't claim without it going on your record. If you make a claim, it will be recorded and you will have to declare it for the next 3-5 years.

Call your insurance company and they will open a claim file. They'll send you out all the necessary paperwork for you to fill in and providing you are insured fully comprehensive, they should organise to get your car repaired. If your insurance company are crap, try www.helphire.co.uk

So, have you actually been diagnosed with whiplash by a medical professional or are you planning on making a quick buck by commiting insurance fraud?

EDIT: If the witness is a passenger in your car, their statement usually doesn't count unless they are totally impartial which isn't likely. I found this to be the case when I had an accident once.

I know it's not your fault but I wouldn't post any accident details on here. Insurance companies seem to read forums these days to try to gather evidence. Maybe I'm being a bit "paranoid" tho..

Best put your Foil Hat back on..

I'd get in contact with your insurance company ASAP, get it sorted minimal hassle

I'd really not claim for whiplash unless you actually have it. If you do have it, get physiotherapy as soon as possible. I delayed my treatment for a few months and i'm still suffering 2 years afterwards (and still no cash might i add). I'd much much rather have no money and no pain though....much rather :(

Why? So the guy made a mistake. As long as he's not being a complete **** about it and is co-operating fully, why do you want to see him 'fry'?

How would you feel if the situation was reversed?

Are you actually injured or do you just want to profit out of this accident in as many possible ways?

sorry to put water on your fire

but the passenger wont cut it as a witness as they are automatically presumed to side with the person in the car with them

you really need an independant witness before they will take notice (having had 4 accidents, 1 of them my fault, 3 others faults ive been there before)

and as for no record. its not possible. if you claim, theres a record, its as simple as that.

what was the accident btw ? you'll have a hard time claiming for whiplash in anything other than a rear end impact.

its worth noting that any cash from whiplash wont come quickly. i was involved in a rear end impact and the compensation took 10 months all in all.

Lots of good advice here, seems this scumbag will damage my insurance record no matter what

No offence, but he was being a little bit of an a$$ about it so in a dog eat dog world. Surely, it is not wrong to come out top dog? ;)

My insurance company has been charging me a fortune for years for no good reason, surely a valid claim for whiplash is not totally unjustified even if it was not rear ended :p

The reason they've been charging you loads of money is because of people claiming for things like whiplash, so you're just adding to the problem, insurance companies have to get their money back from somewhere, so they get it from everyone who has a policy with them by upping the premium.

What actually happened to make him a scum bag?

Bumping into my car whilst departing from a parked position then claiming he was not at fault

you seriously think you can claim whiplash for that?

it is being arsey of him claiming it's not his fault though, just get onto your insurance company and give them the details, then let them sort everything out, that's what you pay them for. You have protected NCB anyway so does it really matter?

If you don't mind me asking, have you got a rough figure? Also, how many months of phsio did you require :) Thx.

True, but the neck is 360 degrees. Thx to him, my NCB goes down by one and I have to pay £300 excess . This was my holiday money :(

I remember a thread on here linking to a different forum where an insurance company spotted a guy making a claim with them and read all about his driving habbits, such as street racing etc, they also tried to say he had nitro fitted to his car due to a t pipe in the fuel line or something stupid, at the end of the day the insurance company were really harsh and unfair but you do have to be careful about what you say on the net.

 How did they track him down, or even recognise him?
