Is it illegal to record someone?

Be honest with her.

Tell her exactly why you were recording her, that you simply wanted to find out why the relationship has failed and what you did wrong to see if you could repair it.

Don't put any blame on her, apologise for doing it and say it will never happen again. Give her any recordings you may have or let her delete them. Then ask her why she wants a divorce, and you want to know no matter how brutal it is, even if she is seeing another man.
 
I would guess that the recordings are held under the data protection act, in which case you can view it yourself but not show it to other people without the permission of the person being filmed. Equally, she has the right to see what has been filmed and you legally, must allow her to do so, unless that footage contains evidence of criminal actions.
 
I doubt its illegal as it was done in your own home however I seriously doubt it would be considered evidence in any legal proceeding especially a divorce case where they've just released new rules surrounding how people can't steal/printoff financial documents of their partner etc without consent.

Also, since when do women know how to remove a HDD from a pc?! They're evolving I swear!

Not mine she'd, just bash it with a big wooden club.

she knows if she's seeing somebody else that the courts will not view it favourably, that's why she's not telling him. He as good as knows because there's not really any other good reason, but just wants to see it for himself by the sounds of things.

You need to notify the person you are recording them. Hence why when you ring a call centre you get the message "All calls maybe monitored or recorded". This is also why the police need a warrant to do any of this kind of stuff. Its abit of a grey area and I maybe wrong.

In general not in your own home you don't... you're exempt from the DPA when placing cameras in your own home just as you are when say taking pictures with a mobile phone etc..

though this is more with the nanny cam type stuff in mind or CCTV for security purposes

if you decide to rig up a camera in a bedroom or bathroom then you might well get in trouble with the law I think that the OP is on dodgy ground if he placed a camera inside the bedroom - fairly dumb tbh... you can quite easily film her walking a guy into the room from a camera in say the corridor without the need to actually breach the privacy of her bedroom.

He should just tell her that he wants to keep it civil and split everything down the middle. He just wants honesty!

Also, hiring a Private Investigator would be better than recording her himself!
 
Well I am gutted that your saved games have been stolen, that must be grounds to divorce her surely !

Now I would agree with previous comments, that you do have to notify some one if are recording them for possible evidence later.
However there is no legal reason why you can not record a room or area for security reasons !
Now being discovered, WTF, you have to much more stealth than present skills.
Have you not watch the Gadget show !
You can get a teddy bear with a web cam in it !
Plus there are a host of Vid Cams that come in different guises.
If she has stolen the hard Drive, then there must be some thing to hind on her part !

there are plenty of sites if you do a google search.
 
Well, I have no legal insight into this at all. However if it was in your own home then I'd expect to be able to record whatever you damn well please.

DPA might apply to not being able to show anyone but that was never your intention (afaik). She has stolen your HDD which is not cool, if you recover it, make sure you put a padlock on your PC case so no one can gain access without really trying.

Also, always make a backup of saved games and important documents.

The most important lesson in all of this has to be disaster recovery. Failure to prepare = prepare to fail.

Because being bitter over something isn't worth it, I've seen far too many people self destruct over something like this.

Split everything down the middle, keep it amicable and move on.

I know its easier to say than do, but hating, revenge and bitterness won't help anything. They move on and you are left with years of ****!

It was illegal and the police may well be interested, if I was your wife, I would be trying to screw you over too. Depending on what you recorded, you could be in some serious trouble, leading to a criminal conviction.

Start grovelling.
 
Nothing is illegal until you get caught! Only when someone observes the illegal activity does it actually become illegal, before that it is both legal and illegal at the same time.

Hence my fav phrase.

"The only crime is getting caught"

Really though I often wonder how couples can get to this state?
 
It's probably a slightly grey area, i doubt it would hold too much weight, consideration would be taking for the fact your married - crime of passion or the like.
 
It's in your home, you can put any video/audio recording equipment where ever you like.

Don't listen to the people saying it's illegal.

You could even give the police permission to record in the house withought your wife knowing (i know thats got nothing to do with this thread, but you can)
