Is it illegal to record someone?

No way! Go down to citizens advice, they will have lawyers on hand no doubt, but you have to remember that courts are not machines, they will take into account the fact that your MARRIED. It sounds like she has gone cold as marriage isn't what she wanted it to be. I really can't see you being prosecuted for this.
 
Do you want to save your marriage? If so talk to her and see if you can get to Relate. If that fails then at least try for an amicable divorce.

If not; man the Hell up. Seriously. Sneaking around recording her has only blown up in your face and given her ammunition in her case for divorce. Again try talking things out with her.

If you think losing your hard drive is bad just wait. If she puts your balls in the vice then you'll know pain.

You could just buy another drive in the short term!
 
If I remember from my Degree days its illegal to record without consent, and most certainly will be frowned upon if used in court. MI5 got in trouble for it when bugging houses without first getting a warrant in a suspected terrorists house. But I guess it depends on what you recorded, I doubt you'll receive a sentence just for it. (Sorry I've not gone through the previous posts :))

It's not necessarily illegal to record without consent (say you record a conversation you have without the other parties knowledge), it's perhaps morally dubious and likely to be inadmissable in a court of law or at least the weight placed on it will be significantly affected.

And I doubt it could be used as evidence either.

Maybe and maybe not, if it was thought to be in the overall interests of justice then the evidence may be allowed although the origins will be noted accordingly. The law may be an ass occasionally but it doesn't always cut off the nose to spite the face.

Deny the camera is yours.

"You see that mp3 player I was recording with, that's not my camera"? I can see that might be a truthful statement but it's slightly curious and likely to lead to further questions. :p
 
Out of interest, how does infidelity effect a divorce case?. If the OP were to have found something out, and maybe used that confirmed suspicion to find actual submittable proof (through a private investigator for instance..) how would that effect divorce proceedings/outcomes?.

The fact that they don't record in people's bedrooms probably has something to do with it... If you're in public you can be photographed, recorded, whatever without consent as there is no expectation of privacy. In the bedroom, there is most definitely an expectation of privacy.

If you're talking about when they catch cowboy builders and whatnot, then I would assume it's because you don't have a reasonable expectation of privacy when you're at someone else's house working on their washing machine. When you're in your own bedroom, though, it's completely different.

PS: To the OP. Tell her you think that the house is haunted and you were trying to record evidence of it. Like in paranormal activity ;)

Its shocking that things have gotten this bad, I think I'd be the same as you, I'd want to know why, and if there was another bloke, I'd want words with him. I'm probably going to be frowned upon here for the advice I'm about to give but...

Who pays her mobile phone bill? Does it come to the house? I'd be damn well tempted to look for any numbers that occur a lot. Grab hold of her phone when she is in the shower and have a good look through the messages, if you can find proof of infidelity it may well do your case the world of good when it comes to dividing up the household. I know its not an honorable thing to do, and I feel pretty dirty suggesting it, but sod it, in for a penny in for a pound.
 
Perhaps this will jog somebody's memory.
I 100% know there was a recent case (maybe involving somebody famous) where one of the couple filmed the other and they got away with it in court.
If I remember correctly the cops had been to a house to arrest one of them and then found loads of secretly filmed videos.
The wife remembers we discussed it at the time but can't remember who it involved.
