Hi guys I just got win7 64 and wanting to upgrade I was wondering if there was anyway I could keep the files I want on the same partition out side the windows folder , I cant really backup all my data since it's too large for my other hardrives

Would the install just go over the current windows folders?

only if you back it up to another drive
as you cant upgrade from 32bit to 64bit, clean install only

from windows site
(Q) Can I upgrade from a 32-bit version of Windows to a 64-bit version of Windows?

(A) No. If you are currently running a 32-bit version of Windows, you can only perform an upgrade to another 32-bit version of Windows. Similarly, if you are running a 64-bit version of Windows, you can only perform an upgrade to another 64-bit version of Windows.

If it cannot do an in-place upgrade, it moves everything into a folder called Windows.old. Everything from the previous installation should be in there. However, if you don't have room to backup your stuff, then may I suggest you go and buy some HDDs! :p

In the very least you should backup anything really important - you never know what may go wrong [or you might screw up ;)]. I am not just talking about a new Windows install either - you never know when a HDD might just go bang.
