when im in my bios and i check cpu temp it is around 37/38 but when i start up my comp and check the temp e.g. with real temp it comes out at 26 when idle..

The bios usually reads temperature from a sensor located underneath or near the cpu socket, whereas the cpu temp software usually reads the temp from a sensor on the cpu die. So technically the software should yield a higher temp but both are known for reported lower than read values to make you feel safer. Probably safer to go with the higher temperature as sensors can malfunction.

My bios temps are always higher than when ive booted into windows and coretemp starts ........... I always thought it was just running hotter at startup :)

use a few cpu temp software programs, there will be a variety of different temps (slight differences) take an average of all them.
