is this mobo faulty or another component - gigabyte h61n

hi

i have brought a new mini itx pc. the mobo is a gigabyte H61N usb3.
the system is this:
core i3 2100t
8 gig of corsair value ram
120 gig agility 3 ssd
pioneer dvd-rw.
thermaltake eco mini itx case with 220wt psu.
win 7 home premium oem.

i put it all together and it turned on fine and windows booted very fast, but it started to crash and blue screen, the usb3 ports didnt work but do now. what was alarming was that when i entered the bios screen it already had F7 bios installed and a message in red saying warning! this motherboard has previously been overclocked and was unstable. i am assuming its an RMA board thats been sent to me accidentally.

the box was a bit battered and the sticky tape was dirty on the mobo anti static bag.

its from a competitor but is that the problem?
 
yes, not had a problem before. i priced both companies and the price was better, thats the only reason. :)
 
its probably just abios setting not right,the red warning message is normal for a failed oc/bios/voltage setting,its nothing to worry about
 
would it cause the system to crash all the time?

but it shouldn't have that on a brand new mobo though surely :)
