Just need to be backed up over accident...

Hi there yesterday I was involved in an accident, the driver pulled out onto a 60 road at a cross junction (he was going straight over)... As far as im aware if someone pulls out and you hit them it is there fault right? its just coz everytime I am speaking to him trying to swap insurance details etc im getting an ear bashing, of him saying oh he didnt see me or I was going too fast... Have searched the net for answers but am stumped...

I have pictures to try and help expalin a little...

This is the view the other driver had of the road I was coming down, So he stopped at this exact point and then tried to cross to the other side... if you see in the distance there is a white car, this is the way I was coming from (from back of pic to front) he pulled out when I was approx 30yards away...

This is my car, I had to swerve so I didnt hit them with a full on side impact... I clipped their front wing airbags went of and I spun around...

This is their car, as you can see I took the bumper off but it could have been worse... I just want to put my mind at rest, coz as far as im aware I had right of way and no matter what if someone pulls out on you it is their fault... but they are not seeing it that way...

thnaks for your support, right from the start I thought I was right but having him say that it was my fault it sort of puts a seed of doubt in your mind... lol i doubt a 1.4 fiesta would do 140... I was doing 50-55, I drive that road everyday and know how dangerous it is... so I always slow down even if its just a little... I mean if your sitting at a junction any car that is coming towards you will look fast, coz i mean 50-60mph is fast!

It may have been less than 30 yeards when he pulled out... I was around the second white line in the middle of the road (from front of pic to back)

I just worry coz I always hear about how a lot of things go 50/50 I dont want any blame... and here get a load of how big the give way sign which he came upto was...

I have included all the pics with the insurance thing I have to fill in saying what happened.

yeah police did come out and took a statement... and breathaliser, fortunatly I dont drink, but was still worried if I would pass it ... they didnt mention anything about who was at fault just that it not a case they will be investigating...

worst part was not hitting him but when the airbags went off and filled the car with dust while I was still spinning... so couldnt see where I was or what was comeing towards me...

it is the B4112 between pailton and withybrook... think its called the fosseway junction...

lol no not going silly speeds but they seemed to think i was, as I said I know the area and know that the junctions along this road are bad... just didnt expect anyone to pull out when I was so close...

It was a young lad driving (late teens early 20s) and he was with his parents who were fairly old...

all these points are brilliant... the damage doesnt look that bad as you said if it was high speed there really would not be much left... think there is a fair but of damge to the underneath and obviosuly where the wheel is on mine but not sure how bad yet...

he hasnty tried the "he was indicating" line yet just them assuming I was speeding... when I know I wasnt and I hope the insurance company know I wasnt...

Coco - I know where you mean, this road goes off the one your talking about... this one leads from pailton to withybrook which I think then goes onto the wolvey/burbage road...

Matt82 - Think I have put down 20 yards, he was really close just couldnt believe anyone would pull out at that distance, but then again he might not have seen me, in which case they couldnt possibly know if I was speeding... which i wasnt...

nevermind, a courtasy car is being sorted, still havent had any word on the amount of damage done yet
