Laptop DVD problem

I purchased a second hand Toshiba laptop to find the dvd drive is faulty.

I found this out when i tried using the recovery cd to do a system recovery.

It makes a loud whirring/scraping noise and the disc won't load, tried other discs (cd/dvd) and still doesn't work.

I opened the dvd door and sat the disc on it and if i slowly spin the cd you can see it's not even (as though it's had some force on it).

I have offered the person whom I purchased it from two options...

1) I return the laptop and want a full refund.

2) Pay £25 towards a new drive.

My question is how easy are the drives to replace and will any ATA drive do or does it have to be an identical drive?

drives on toshiba's are usually just a screw on the base and it pops out, what model is it? Any ide drive will work but if yours has a curved bezel it might not fit the new drive, what model drive is it?
 
The laptop is a Toshiba Equium L40-10U

The drive is ...
DVD Super Multi (Double Layer) drive

It has a flat bezel so should be fine there, does that mean like it's a hot swapable drive (don't have to take the laptop apart?).
 
Right the screw holding it in was in beneath the hdd cover.

Managed to get it out, just need to get a replacement now, the woman we purchase off said " it was ok when i shipped it" and I stated "No Returns!!"

Pfft!!!
